Homebuyer Rights Under RERA: Legal Action on Construction Defects

Thousands of Indian home buyers who notice cracks, seepage, and structural failures or property defects after possession in newly purchased homes are often helpless, yet the law is on their side. Homebuyer rights under RERA are well spelled out under the Real Estate ( Regulation and Development ) Act, 2016, which gives the buyer a solid legal framework to challenge the poor quality of construction and hold the builder responsible.


According to RERA guidelines for housing projects, Section 14(3) of RERA, in case of any structural defect or poor quality in workmanship, services, or materials are found within 5 years of actual possession, then the builder is legally liable to remedy the defect or poor quality at no additional cost to the homebuyer. This provision is known as RERA— 5-year defect liability period. It is one of the most robust buyer protection laws in the real estate sector that India has witnessed. What are structural defects in real estate?


Structural defects are usually caused by poor design, quality of construction, or materials. Poor quality of raw materials leads to leakage and dampness, and failures in construction lead to cracks in the foundation, plumbing problems, electrical and mechanical problems, all subject to the defect liability clause of RERA. Understanding this scope is very important for exercising homebuyer rights under RERA effectively.


After a defect is reported, developers have to correct the defect within 30 days of being notified about the defect by the allottee. The inability to deal with such problems may result in compensation claims by the aggrieved buyer. Homebuyer rights under RERA render the compensation for builder construction defects a right that is legally enforceable, as opposed to a moral obligation.


How to file a complaint in RERA?


Homebuyers who are victims of builder negligence may make a complaint under Section 31 of the Act directly on their respective State RERA portal under RERA rules for builders in India. State RERA authorities are obligated to take legal action against poor construction quality within 60 days, and thus, it is a much more convenient path towards compensation for buyers. They can also seek further legal redress from the Consumer Court under the Consumer Protection Act.
